ShopBack Privacy Policy

ShopBack Inc (“ShopBack,” “we,” “us,” or “our”), provides shopping experiences to allow our merchants to reach more customers, and our customers to discover the best prices and offers, pay easily, and get rewarded for shopping. We respect the privacy and confidentiality of the personal data of our clients, customers, visitors, and all others with whom we interact with providing our services. While we are driven by the goal of providing customers with an enhanced shopping experience, we also understand that a key concern that customers may have, is the safety of their personal data.

1. SCOPE AND UPDATES TO THIS PRIVACY NOTICE

The purpose of this Privacy Notice (“Privacy Notice”) is to inform you as to how ShopBack manages, collects, uses, and discloses Personal Data (as defined below), relating to you as a user of our cashback services via our various platforms including our website, extension for desktop web browsers (“Web Extension”), software applications, mobile applications and other platforms (“ShopBack Platforms”), and to help you understand and exercise your privacy rights.

Changes to our Privacy Policy. We may modify and update this Privacy Notice from time to time in our sole discretion. If there are any material changes to this Privacy Notice, we will notify you as required by applicable law.

2. PERSONAL DATA WE COLLECT AND PROCESS

Under this Privacy Notice, “Personal Data” means any information that is defined as “personal data” or other similar term under applicable privacy laws, including information that relates to an identified or identifiable individual, or that may be used to identify an individual, household or device, including name, street address, telephone number, email address, photograph, IP addresses, device identifiers, or other persistent identifiers.   

The categories of Personal Data ShopBack collects and processes depend on how you interact with us, our services, products and promotions, and the requirements of applicable law. We collect and process data that you provide to us, information we obtain automatically when you use our services, and information from other sources such as third-party services and organizations, as described below.

A. Personal Data You Provide to Us Directly

We may collect Personal Data that you provide to us.

  • Customer Account Creation. We may collect and process Personal Data when you create a ShopBack account on the ShopBack Platform or when you visit, use, or install our ShopBack Platform, such as full name, email address, physical address, telephone number, gender, date of birth, etc.
  • Customer Purchases. We may collect and process Personal Data and details associated with your purchases with us, or from our merchant partner’s website through our ShopBack Platforms, including payment information (e.g., payment methods, bank account details, details of your account with a payment service provider such as PayPal, credit/debit card information, etc.), cashback balance and information on your transactions (e.g., merchant partner, amount spent, date of purchase, product purchased).
  • Customer Preferences. We may collect and process Personal Data that relates to any preferences that you share with us, such as your preferred products and brands, the activation of services, etc. 
  • Customers’ Communications with Us. We may collect and process Personal Data, such as email address, email content, mobile number or contact preferences when you request information about our services, send or submit any of our forms, request assistance for our services, use any of our portals relating to our products or services, sign up for our newsletters or alerts, or request marketing information (e.g., advertisements, brochures, or flyers), request customer or technical support, or otherwise communicate with us.
  • Surveys. We may contact you to participate in surveys. If you decide to participate, we may collect Personal Data from you in connection with the survey.
  • Interactive Features. We and others who use our services may collect and process Personal Data, such as name, email, gender, birthday, etc., that you submit or make available through our interactive features (e.g., messaging and chat features, commenting functionalities, forums, blogs, and social media platforms). Any information you provide using the public sharing features of the Services will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein. 
  • Sweepstakes, Competitions, and Lucky Draws. We may collect and process Personal Data you provide for any sweepstakes, competitions, lucky draws, or other similar events that we offer. In some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.
  • Conferences, Trade Shows, and Other Events. We may collect and process Personal Data from individuals when we attend or host conferences, trade shows, and other events (e.g., marketing events, community events, and seminars on behalf of yourself or as a representative of another entity). 
  • Business Development and Strategic Partnerships. We may collect and process Personal Data from individuals, authorized representatives, and third parties to assess and pursue potential business opportunities. 
  • Job Applications. We may post job openings and opportunities on our services. If you respond to one of these postings, we may collect your Personal Data, such as your application, CV, cover letter, and/or any other information you provide to us.

B. Personal Data Collected Automatically

We may collect and process Personal Data automatically when you use our services or ShopBack Platform.

  • Automatic Collection of Personal Data. We may collect and process certain information automatically when you use our ShopBack Platform, services, , such as your Internet protocol (IP) address, user settings, MAC address, device ID, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device characteristics, device configuration, location information (including approximate location derived from IP address), and Internet service provider. We may also automatically collect information regarding your use of our services or visit our merchants’ services, such as pages that you visit before, during and after using our services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our services or ShopBack Platform. 
  • Cookies, Web Extensions, and Application Browser Details. We, as well as third parties that provide content, advertising, or other functionality on our ShopBack Platform or services, may use cookies (which are small data files sent to your browser to store and track information about you when you enter our website), pixel tags, and other technologies (collectively, “Technologies”) to automatically collect information through your use of our services. These Technologies may collect information relating to your interactions with us directly and our merchant partners’ websites (e.g., the pages within our website that you visit, time spent on those pages, items and information searched on our site, access time and dates, webpages you were visiting prior to our site, and information relating to clicks and redirects), and data related to your transactions with our merchant partners. You can find additional information on our use of the Technologies, the purpose of these Technologies, and how to manage the use of these Technologies in our Cookies Notice.
    • Strictly Necessary. They are used to provide you with our services, such as being able to display our ShopBack Platforms on your device, recognize you when you sign in to use our services, track information relating to your interaction with the ShopBack Platform and our merchants to ensure your cashback is tracked, facilitate the purchase and payment of goods, and prevent fraudulent activities and ensure the security of our platforms as set out in our Cookies Notice. 
    • Functionally Necessary. This includes Technologies that are used to enhance functionality and personalization of our services. They may be set by us or by third parties whose services we have added to our pages. 
    • Performance and Analytics. This includes Technologies that allow us to count visits and traffic sources so that we can measure and improve the performance of the ShopBack Platforms. They help us know which pages are the most and least popular and how visitors move around the website. All information collected from performance and analytics Technologies is aggregated. One of our analytics partners includes:
      • Google Analytics.  For more information about how Google uses your personal information (including for its own purposes, e.g., for profiling or linking it to other data), or how to opt-out of Google Analytics’ use of your information, please visit Google Analytics’ Privacy Policy.
    • Advertising. This includes Technologies that allow us to deliver certain types of advertisements for products and services that are not available on ShopBack Platforms, certain advertisements that are relevant for your interests, display features, products and services that may be of interest to you, including advertising of our own services, and deliver customized features and services. Approved third parties may also set Technologies when you interact with our website. These third parties include search engines, measurement and analytics providers, social media networks and advertising companies. Third parties use Technologies in delivering advertising content, including ads relevant to your interests, to measure the effectiveness of their advertisements and to provide services on behalf of ShopBack.
  • Web Extension. We may collect and process Personal Data automatically when you use the ShopBack Web Extension. The Web Extension only collects data (e.g., merchant partner’s name, domain, page views, success of coupon usage, amount saved per coupon, browser type, operating system, error logs, event stamp) from ShopBack’s merchant partners’ websites. We do not collect browsing data from your search engine history, email content, your browsing data, or information from websites that are not ShopBack merchant partners or where the information is not related to ShopBack’s products or services. On our merchant partners’ websites (which are indicated by a blinking ShopBack icon), the ShopBack Web Extension will collect information to help ShopBack determine if it is a site supported by ShopBack. Accordingly, ShopBack may find the relevant coupons, rewards, cashback, and promos available to you. 

C. Personal Data Collected from Other Sources

  • Third-Party Services and Sources. We may obtain Personal Data about you from other sources, including through third-party services and organizations. For example, if you access our services through a third-party application, such as an app store, a third-party login service, or a social media provider, we may collect and process Personal Data about you from that third-party application that you have made available via your privacy settings. 
  • Referrals. We may collect and process Personal Data if you are referred to us by our business partners or third parties.

3. HOW WE USE YOUR PERSONAL DATA

We may use your Personal Data for a variety of business purposes, including to provide our services, for administrative purposes, and to market our products and services, as described below.

A. Provide Our Services

We may use your information to fulfill our contract with you and provide you with our services, such as:

  • Managing your information and accounts;
  • Fulfilling and processing your orders and cashback;
  • Providing access to certain areas, functionalities, and features of our services;
  • Understanding your preferences;
  • Delivering periodic newsletters;
  • Promoting benefits, offers, and rewards that you qualify for;
  • Answering requests for customer or technical support or providing directory assistance; 
  • Providing you with updates on our products, services, or policies;
  • Communicating with you about your account, activities on our services, and policy changes;
  • Processing your financial information and other payment methods for products or Services purchased;
  • Processing applications if you apply for a job we post on our services; and
  • Allowing you to register for events, loyalty programs, rewards programs, contests, competitions, or corporate social responsibility projects.

B. Administrative Purposes

We may use your information for various administrative purposes, such as:

  • Pursuing our legitimate interests such as direct marketing, research, and development (including marketing research), network and information security, and fraud prevention;
  • Conducting checks against money laundering, terrorism financing, credit and fraud risk;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
  • Investigate complaints, claims, and disputes;
  • Conducting internal audits;
  • Measuring interest and engagement in our services; 
  • Short-term, transient use, such as contextual customization of ads;
  • Improving, upgrading, or enhancing our services or site performance; 
  • Developing new products and services;
  • Ensuring internal quality control and safety;
  • Authenticating and verifying individual identities, including requests to exercise your rights under this Privacy Notice;
  • Debugging to identify and repair errors with our services;
  • Auditing relating to interactions, transactions, and other compliance activities;
  • Sharing personal data with third parties as needed to provide the services;
  • Enforcing our agreements and policies; and
  • Carrying out activities that are required to comply with our legal or regulatory obligations, including providing assistance to law enforcement, judicial, and other government agencies, responding to regulatory complaints, making relevant disclosures to regulatory bodies, conducting audit checks, due diligence and investigations, and taking steps which ShopBack considers necessary in the event of a lawsuit or potential lawsuit.

C. Marketing and Advertising our Products and Services

We may use Personal Data to tailor and provide you with content and advertisements, including details about our preferred partners’ products, services, special offers, and rewards. We may provide you with these materials as permitted by applicable law. 

Some of the ways we market to you include email campaigns, text messages, custom audiences advertising, and “interest-based” or “personalized advertising,” including through cross-device tracking.

D. With Your Consent

We may use Personal Data for other purposes that are clearly disclosed to you at the time you provide Personal Data or with your consent.

E. Other Purposes

We also use your Personal Data for other purposes as requested by you or as permitted by applicable law.

Automated Decision Making: We may engage in automated decision making, including profiling. For example, we may engage in automated decision making to analyze, determine available rewards, and approve rewards. ShopBack’s processing of your Personal Data will not result in a decision based solely on automated processing that significantly affects you unless such a decision is necessary as part of a contract we have with you, we have your consent, or we are permitted by law to engage in such automated decision making. 4. HOW WE DISCLOSE YOUR PERSONAL DATA

We may disclose, share, or transfer your Personal Data to third parties for a variety of business purposes, including to provide our services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below. 

A. Disclosures to Provide our Services

The categories of third parties with whom we may share your Personal Data are described below. 

  • Service Providers. We may share your Personal Data with our third-party service providers, merchant partners, payment service providers, professional advisors, and vendors that assist us with the provision of our services. These services may include IT support, hosting, marketing, telecommunications, printing, billing, payroll, processing, technical services, training, market research, call centers, payment processing, fraud risk monitoring, legal advice, customer service, and related services.
  • Business Partners. We may share your Personal Data with business partners to provide you with a product or service you have requested. We may also share your Personal Data with business partners with whom we jointly offer products or services. For example, when you click on a link to a merchant site presented on our services to start your cash back shopping, you evidence your intent to interact with that business partner through our services, and are thereby directing us to disclose certain information about you (including the link you clicked in our services and a unique ID assigned to track that your shopping originated from our services), to an affiliate network to properly account for your purchases with the merchant you wish to shop with. For a small number of merchants that do not utilize an affiliate network, this information is provided directly to the merchant. Each merchant’s and/or affiliate network’s privacy notice (rather than our privacy notice), describes how the merchant (or the affiliate network with whom the merchant has chosen to work), will use, disclose and otherwise process your Personal Data.  Please carefully review each merchant and/or affiliate network’s privacy notice prior to directing us to disclose your Personal Data to the merchant and/or affiliate network. When you click on a link to a merchants’ or affiliate networks’ site presented on our services, you are directing us to disclose your Personal Data to such merchants and/or affiliate networks, and consequently, such disclosure is not considered a “sale” or “sharing” of your Personal Data as those terms are defined under applicable US state privacy laws. 
  • Affiliates. We may share your Personal Data with our company affiliates and the ShopBack group head company of regional operations (Ecommerce Enablers Pte. Ltd. located in Singapore) for example: for our administrative purposes, IT management, or for them to provide services to you or support and supplement the Services we provide. 
  • Advertising Partners. We may share your Personal Data with third-party advertising partners. These third-party advertising partners may set Technologies and other tracking tools on our services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising.”
  • APIs/SDKs. We may use third-party application program interfaces (“APIs”) and software development kits (“SDKs”) as part of the functionality of our services. For more information about our use of APIs and SDKs, please contact us as set forth in “Contact Us” below.

B. Disclosures to Protect Us or Others

We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

C. Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract, to any business partner, investor, assignee, transferee and their external consultants (e.g., lawyers, management consultants, or auditors), experts, and other service providers for the purposes of facilitating such a transaction.

5. YOUR PRIVACY CHOICES AND RIGHTS

Your Privacy Choices. The privacy choices you may have about your Personal Data are determined by applicable law and are described below. 

  • Email Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding us and our services, and you will not be able to opt out of those communications (e.g., communications regarding our services or updates to our Terms or this Privacy Notice.
  • Text Messages. If you receive an unwanted text message from us, you may opt out of receiving future text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us as set forth in “Contact Us” below.
  • Mobile Devices. We may send you push notifications through our mobile application. You may opt out from receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information via our mobile application. You may opt out of this collection by changing the settings on your mobile device.
  • Phone Calls. If you receive an unwanted phone call from us, you may opt out of receiving future phone calls from us by following the instructions which may be available on the call or by otherwise contacting us as set forth in “Contact Us” below.

Your Privacy Rights. In accordance with applicable law, you may have the right to:

  • Confirm and Access your Personal Data, including: (i) confirming whether we process your Personal Data, unless doing so would require us to reveal a trade secret; and (ii) obtain access to your Personal Data. Where applicable, you may request that we disclose the following information to you about our collection and use of your Personal Data, in each case including Sensitive Personal Data: (1) the categories of Personal Data we collected or processed about you; (2) the categories of sources from which we collected this Personal Data; (3) the categories of Personal Data that we have sold, shared, or disclosed, (4) the categories of recipients to whom this information was sold, shared, or disclosed; (5) the business or commercial purpose for selling, sharing, or disclosing Personal Data; and (6) the specific pieces of Personal Data we collected about you;
  • Portability of Your Personal Data, including receiving an electronic copy of Personal Data that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine-readable format (to the extent technically feasible) that allows you to transmit the data to another controller without hindrance. Colorado residents may exercise this right no more than two times per calendar year. We are not required to provide such information to Connecticut, Colorado, and Oregon residents if doing so would require us to reveal a trade secret. Oregon and Delaware residents may request a list of specific third parties to whom we have disclosed your Personal Data;
  • Update your Personal Data by accessing your account on the ShopBack website;
  • Request Correction of your Personal Data where it is inaccurate or incomplete, taking into account the nature of the information and the purpose of processing that information. In some cases, we may provide self-service tools that enable you to update your Personal Data, such as by updating such information in your account settings;
  • Request Deletion of your Personal Data. We may limit or deny your deletion request in certain cases, in accordance with exceptions specified in the applicable laws;
  • Opt-Out of Sale or Sharing of Personal Data. You may opt out of our “sharing” of Personal Data for the purposes of (i) targeted advertising or (ii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. Please contact us as set forth in “Contact Us” below to exercise this right. Opt-out preferences will be processed in accordance with applicable laws. If we receive an opt-out preference signal that conflicts with your participation in our cash back program, we may notify you that processing the opt-out preference signal is a valid request to opt-out of the “sharing” of Personal Data and will withdraw you from any financial incentive or cash back programs. We will ask you to affirm that you intend to withdraw from any such financial incentive programs. Please note that we do not under any circumstances, “sell” your Personal Data as defined under applicable laws.

6. SECURITY OF YOUR DATA

We are committed to implementing policies, practices, and processes to safeguard the collection, use and disclosure of the Personal Data you provide us, in compliance with the applicable personal data protection laws, including with GDPR, and in accordance with this Privacy Notice. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any Personal Data you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of Personal Data.

By using our services or providing Personal Data to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our services, by mail, or by sending an email to you.

7.  INTERNATIONAL DATA TRANSFERS 

All data processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States, the European Economic Area (EEA), or other countries, which may have data protection laws that are different from the laws where you live. As the head office for regional operations of ShopBack group, Ecommerce Enablers Pte. Ltd. is located in Singapore, your Personal Data is transferred to Singapore as part of our contract with you for providing our services. We endeavor to safeguard your information consistent with the requirements of applicable laws.

8. RETENTION OF PERSONAL DATA 

We store the Personal Data we collect as described in this Privacy Notice for as long as you use our services, as described in this Privacy Notice, or as necessary to fulfill the purpose(s) for which it was collected, provide our services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.  

9. SUPPLEMENTAL NOTICE FOR US RESIDENTS

This Supplemental Notice for US residents only applies to our processing of Personal Data that is subject to the US state privacy laws. The US state privacy laws provide US residents with the right to know what categories of Personal Data has collected and processed about them, and whether ShopBack disclosed that Personal Data for a business purpose (e.g., to a service provider) in the preceding twelve months. “Sales” of Personal Data 

ShopBack does not “sell” Personal Data, nor do we have actual knowledge of any “sale” of Personal Data of minors under 16 years of age.

Additional Privacy Rights for US Residents

Non-Discrimination. US residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the applicable privacy laws. 

Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Data. You may also make a verifiable consumer request on behalf of your minor child. To authorize an agent, provide written authorization signed by you and your designated agent and contact us as set forth in “Contact Us” below for additional instructions.

Verification. To protect your privacy, we will take steps to reasonably verify your identity before fulfilling your request. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative, or to answer questions regarding your account and use of our services.

Appeal. Under certain US state privacy laws, you may also appeal to our refusal to take action on a consumer request. Within 45 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written application of the reasons for the decision. 

Under the Colorado state privacy law, we may extend the 45-day period to response to an appeal by another 60 days, where reasonably necessary, taking into account the complexity and number of requests serving as the basis of appeal. We will inform Colorado consumers of any extension within 45 days after receipt of an appeal, together with the reasons for delay.

If the appeal is denied, Virginia, Colorado, Connecticut, Delaware, Iowa, Montana, Oregon, Nebraska, New Hampshire, New Jersey, Tennessee, and Texas consumers may contact their state Attorney General and submit a complaint.

Incentive Programs. As described above in “How We Use Your Personal Data”, we may offer referral programs or other incentivized data collection programs. For example, we may offer incentives to you such as discounts or promotional items or credit in connection with these programs, wherein you share a unique referral link with your friends and colleagues and receive rewards when they sign up to use our services. (The referred party may also receive rewards for signing up via your referral.) These programs are entirely voluntary and allow us to grow our business and provide additional benefits to you. 

De-Identified Information. If we create or receive de-identified information, we will not attempt to reidentify such information, except to comply with applicable law. 

10. SUPPLEMENTAL NOTICE FOR NEVADA RESIDENTS

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at dpo@shopback.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A. 11. CHILDREN’S DATA

The services are not directed to children under thirteen (13) years old, and we do not knowingly collect Personal Data from children. Protecting children’s privacy online is very important to us.
